The Romanian Judges’ Forum Association denounces the message of the Section for Judges of the Superior Council of Magistracy

The press release published today by the Section for Judges of the Superior Council of Magistracy regarding Decision no. 1348/09.06.2026 destroys any chance of a dialogue between the judiciary and civil society and the other powers of the state and casts serious doubt on the credibility of justice itself.
A quasi-unanimous support, at the level of all courts, of this message not specific to the discourse of the judiciary, found mainly in the content of Decision no. 1348/09.06.2026, with attacks on political parties, representatives of non-governmental organizations, newspapers and press websites, individuals indicated by name and surname, as well as some associations of judges and prosecutors inconvenient for the issuer, is unreal.
The 3580 judges who are said to „denounce the attempt to subjugate the judiciary by the political power” did not vote on such material containing the content of Decision no. 1348/09.06.2026 (which was not even communicated to the judges in advance, as they were not aware of its contents) in the general meetings organized yesterday, June 9, 2026, meetings that had as their object reactions related to the errors regarding the salaries of magistrates, found in the project published by the Ministry of Labor, Family, Youth and Social Solidarity, indicated by all judges and prosecutors, including the Romanian Judges’ Forum Association.
Furthermore, the 3,580 judges did not criticize the documentary Recorder, following which a whistleblower magistrate is subject to disciplinary proceedings, the reactions of the press or public opinion targeting any legitimate criticism related to the functioning of the judiciary, they did not discuss the issue of the non-application of the Lin judgment of the Court of Justice of the European Union, following two binding interpretative judgments of the High Court of Cassation and Justice, nor did they criticize the activity of the prosecutors’ offices.
The European Court of Human Rights has consistently reiterated that issues regarding the functioning of the judiciary constitute matters of public interest, and their debate enjoys the protection of Article 10 of the Convention, underlining the special role in society of the judiciary, which, as a guarantor of justice as a fundamental value in a state governed by the rule of law, must enjoy the trust of the public in order to successfully fulfill its mission.
The press release published today by the Section for Judges of the Superior Council of Magistracy shows without a doubt that this authority does not want reforms in the judiciary, constantly requested by the European Commission, the Organization for Economic Cooperation and Development (OECD), the Court of Justice of the European Union, etc., European and international bodies.
Also, the Romanian Judges’ Forum Association is analyzing the possibility of taking legal action against the Section for Judges of the Superior Council of Magistracy for the unrealistic statements made towards its members, contained in Decision no. 1348/09.06.2026, and which are likely to put unjustified pressure related to the functioning of an association of magistrates, with flagrant disregard for Opinion no. 23 (2020) of the Consultative Council of European Judges (CCJE), which establishes that associations of magistrates are essential for defending the independence of the judiciary and the rule of law. They have the right to express public views on legislative reforms and to represent professional interests before the authorities.
Finally, the Romanian Judges’ Forum Association notes the existence on the SCM website of hundreds of handwritten signatures of judges, subject to a total risk of fraud – csm1909.ro/ViewFile.ashx?guid=68a63aff-ee25-4bc7-8d4d-b6b788a20543-InfoCSM, the National Supervisory Authority (ANSPDCP) having the obligation to verify compliance with Regulation (EU) 2016/679.
